Service Agreement

The use of the 4yachting.com system and its 4yachting subsidiaries ("web site") is governed by Service agreement set forth below ("Service Agreement"). Please read it carefully. The Service Agreement is a legal document and, by use of the web site you agree to be bound by this Service Agreement. If you do not wish to be bound by these Service Agreement, please do not visit or use the Web sites.
The web site reserves the right, in its sole discretion, to revise the Service Agreement at any time. You are responsible for regularly reviewing the Service Agreement on the Web sites to become familiar with any changes that may be made from time to time.
The web site may in its sole discretion, without notice and at any time, terminate your access to and use of the Web sites or any portion thereof.
Membership Pricing:Membership in 4yachting is free of charge for yacht owners, and their official representatives.
Translation services: 4yachting translation service, you will be charged 0.12$ per word, per language.
Ownership of Intellectual Property Rights: All content displayed on the web site, including without limitation the web sites' look and feel, text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, trade names, the URL, and software, is the property of 4yachting.com websites. The compilation, coordination, selection, order and arrangement of any of these Content is the exclusive property of 4yachting.com. Any material (including any intellectual property rights in such material), including but not limited to material sent via chat services, feedback, bulletin boards or articles or any other material submitted for publication on the web site or in using any of the web site services may be retained as the property of 4yaching.com.
Members Material: Although Members retain ownership of the original text including compiled factual summaries, photos and other works they provide to 4yachting ("Member Materials"), 4yachting owns a license in and to the Member Materials. In addition, once the Member Materials are posted on the Web sites, they become part of the Web sites and the Content that is protectable by 4yachting.
Only Members and their authorized agents are permitted to access password protected and members-only areas of Web sites. 4yachting.com provided that such access is otherwise permitted by these Service Agreement. Members are not permitted to share passwords with non-Members or otherwise permit or facilitate non-Members' access to Members Only Areas if it would result in a violation of these Service Agreement.

Other Restrictions on Use:Every visitor and Member of the Web sites agree that s/he will not use the Web sites or Content to:

1. Violate any local, state, national or international laws, rules or regulations.
2. Post, upload or transmit Visitor Materials or Member Materials that infringe upon or violate third party intellectual property rights, including without limitation trademark, copyright, patent and trade secret rights.
3. Post, upload, transmit, send, receive, download, store, use, distribute or publish any material that infringe the privacy or publicity rights.
4. Post, upload or transmit Content, information or material that you know or have reason to know to be false or misleading.
5. Post, upload or transmit to 4yachting.com or its affiliates false, incomplete, inaccurate or misleading user information.
6. Post, upload or transmit Content, information or material that is unlawful, obscene, defamatory, threatening, harassing, abusive, hateful, tortuous, libelous, defamatory, slanderous, vulgar, invasive of another's privacy, racially, ethnically or otherwise objectionable or embarrassing to a third party.
7. Post, upload or transmit Content, information or material which is protected by an agreement of confidentiality or which you do not have a right to post, upload or transmit under law or by contract.
8. Post, upload or transmit chain letters, junk mail, pyramid schemes, spam or other forms of advertisements or solicitations.
9. Impersonate another person, whether a third party or a 4yachting.com representative or moderator. or falsely state or otherwise misrepresent the Web sites' visitor's or Member's affiliation with a person or entity.
10. Engage in any conduct that limits any other person from using or enjoying the Web sites or Content.
11. Engage in any conduct that, in 4yachting.com's opinion, violates any law or exposes 4yachting.com or any of its affiliates, customers or suppliers to any liability or detriment of any type.
12. Alter, delete, interfere with or otherwise damage any portion of the Web sites.
13. Engage in, or use in connection with, any commercial enterprise, unless otherwise expressly authorized herein.
14. Transmit any Content that contains any virus, Trojan horse or other computer code, files or programs designed to interrupt, corrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment or otherwise interfere with or disrupt the Web sites or any servers or networks connected to the Web sites.

By using the web site you agree to indemnify 4yachting.com against any claims, costs, expenses or legal proceedings caused as a result of your use of the Web Site or Web Site Services in contravention of this Clause. Further in these circumstances, 4yachting.com shall be entitled to treat the contravention as a material breach of this Service Agreement and terminate the Service Agreement and any access permission granted to you by 4yachting.com forthwith, without notice to you.

4yachting.com shall not be liable to you in contract, tort, and negligence (other than fraudulent or negligent misrepresentations) or otherwise for: Any economic loss, including without limitation, loss of revenue, business, contracts, profits or anticipated savings. Any loss of goodwill or reputation. Any loss of data. Any special, indirect or consequential loss.
